Legal provisions - Electoral Law
• The candidacies presented for the elections of deputies to the congress, municipalities and members of the island councils and of the Canary Island councils in the terms provided for in this law, deputies to the European parliament and members of the legislative assemblies of the Autonomous Communities must have a balanced composition of women and men, so that in the list as a whole the candidates of each of the sexes make up at least forty percent. When the number of positions to be filled is less than five, the proportion of women and men will be as close as possible to numerical balance. The minimum proportion of forty percent will also be maintained in each section of five places. When the last section of the list does not reach five places, the aforementioned proportion of women and men in that section will be as close as possible to the numerical balance, although the required proportion with respect to the list as a whole must be maintained in any case. The rules contained in the previous sections will be applied to the lists of substitute candidates. (Election law, article 44bis)
• The candidacies presented must be published on the twenty-second day after the call for applications in the manner established by the special provisions of this law. Two days later, the competent electoral boards notify the representatives of the candidacies of any irregularities, which were appraised ex officio or denounced by other representatives. The period for correction is forty-eight hours. The competent electoral boards carry out the declaration of candidates on the twenty-seventh day after the call for applications. The declaration of candidacies that fail to comply with the requirements indicated in the previous articles or those established by the special provisions of this law will not proceed. The declared candidacies must be published on the twenty-eighth day after the call for applications, in the manner established by the special provisions of this Law. (Election law, article 47)
