• Parity for the purposes of the application of this law means the minimum representation of 36% of women on the list for elected positions. To comply with the provisions of the preceding paragraph, nominees’ lists submitted by parties may not contain only candidates of the same kind in order to respect the above-mentioned parity. The ordering of each gender in the composition of alternate candidate lists shall be identical with the ordering in the composition of effective candidate lists. (Parity law, article 4)
• If a list does not comply with this law, the representative shall be notified, in accordance with the applicable electoral law, to correct it. (Parity law, article 5)
• Failure to correct the lists within the timeframe provided for in the respective electoral law cumulatively determines: the public posting of the lists indicating their non-compliance with the present law; its disclosure in the media; the reduction of the amount of public subsidies for election campaigns, if any, under the terms of this law; the loss of all tax exemptions when granted. • Within forty-eight hours of receipt of the communication provided for in the preceding article the National electoral commission shall ensure the disclosure, through the media, of the lists which does not respect the parity established in this law. (Parity law, article 8)
• The parties or coalitions of parties which do not comply with the provisions of paragraph 1 of article 4 shall have a reduction of the public subsidy allocated for the election campaigns to which they are entitled under article 47 of Law n. 11/2013 of 25 September. (Parity law, article 9)
• Parties or coalitions of parties which violate the provisions of paragraphs 1 and 2 of article 4 shall forfeit all tax exemptions which they would have enjoy under article 26 of Law no. 2/91, of 9 May. (Parity law, article 10)
