Legal provisions - Electoral Law
• In the event of a mistake in the presentation of a candidacy, or when a candidate for the presidential, legislative, senatorial, regional or municipal elections does not meet the conditions laid down, any interested party may, within three days of the publication of the provisional list of candidates by the A.N.E., refer the matter to the Constitutional Court which rules within fifteen days. The requests are addressed in writing, for the electors of Bangui, to the president of the Constitutional Court and, for the provincial electors, to the division of the ANE in the jurisdiction of which the contested election took place, for transmission to the Constitutional Court. In the event of an unjustified refusal by the A.N.E. to register a candidacy for any of the elections listed in the previous paragraph, any interested candidate may, within three days following the publication of the provisional list of candidates by the ANE, apply to the Constitutional Court which decides within a fortnight. In case of refusal, the person concerned directly appeals to the Constitutional Court. This same right of appeal may be exercised by the legally constituted party, association or political group that presented or sponsored the candidacy subject to the refusal of registration. From the publication of the provisional list of candidates, the A.N.E. can only modify it in execution of the decisions of the Constitutional Court. No recourse free of charge to modify the mentions of the provisional or final list may be presented to the A.N.E. (Electoral code, article 92)
