Single House:
The lists of candidates for the Senate and the Chamber of Deputies of the Congress of the Republic and the Andean Parliament, in general elections, are determined as follows:
1. Nomination in internal or primary elections…The set of candidates is made up of fifty percent (50%) of women or men, placed alternately as follows: one woman, one man or one man, one woman. In the nomination for single-member constituencies, a list with two candidates is presented, composed of one man and one woman or vice versa.
2. List resulting from internal or primary elections…shall be ordered according to the result of the voting and respecting the fifty percent (50%) of women or men. The candidates who obtain the highest number of votes occupy the first places, but once the maximum number of candidates of the same sex is covered, the list continues with the candidate of the opposite sex required to comply with the minimum quota. The final list is arranged in the following order: one woman, one man or one man, one woman. Candidates who for any reason cannot make the final list must be replaced by another candidate of the same sex, in order to ensure parity and alternation.
3. List of candidates for the general elections. In the list for the Senate and Chamber of Deputies of the Congress of the Republic and the Andean Parliament, for the general elections, the results of the internal democracy are considered and the candidates are placed in an intercalary manner: a woman, a man, a woman and a woman of the same sex. The list for the Senate and Chamber of Deputies of the Congress of the Republic and the Andean Parliament, for the general elections, takes into account the results of internal democracy and candidates are placed in an intercalary manner: one woman, one man or one man, one woman. Likewise, in the referred list for general elections of uninominal constituencies, a list with two candidacies is presented, composed of a man and a woman or vice versa.” (Organic Law on Elections, article 116).
• The affirmative measure indicated in Article 116 of the Organic Law on Elections is applied progressively, as follows:
1. General Elections of the year 2026.- The lists of candidates for the Congress of the Republic must include forty-five percent (45%) of women or men, located in an interspersed manner: a woman, a man, or a man, a woman.
2. General Elections of the year 2031.- The lists of candidates for the Congress of the Republic must include fifty percent (50%) of women or men, located in an interspersed manner: a woman, a man, or a man, a woman. (Law No. 30996 amending the organic law on elections regarding the National Electoral System, transitional supplementary provisions)
