Article 16 of the Constitution of South Sudan states that ‘All levels of government shall: promote women’s participation in public life and their representation in the legislative and executive organs by at least twenty-five per cent as an affirmative action to redress imbalances created by history, customs, and traditions’.

Lower House:
• The National Legislative Assembly shall be composed of 25% women members, elected on the basis of proportional representation at the national level from closed party lists. There are party lists and women lists, a voter gets one vote for each. The total number of women members of the National Legislative Assembly shall be 250 men and women. (National Elections Act, article 60)
Upper House:
• There shall be four representatives from each state in the Council of States elected by members of the State Legislative Assembly; one representative shall be a woman. Every member of the State Legislative Assembly has four votes, one of which must be cast for a woman. The top four candidates with the highest number of valid votes shall be declared elected. (National Elections Act, article 60)
