Lower House:
• The candidacies that are presented for the elections of deputies to the Congress should have a balanced composition of women and men, so that in the whole list the candidates of each sexes represent at least 40%. When the number of positions to be filled is less than five, the proportion of women and men will be as close as possible to a numerical balance. The minimum proportion of 40% will also be maintained in each five-way section. When the last section of the list does not reach five positions, the aforementioned proportion of women and men in that section will be as close as possible to the numerical balance, although the proportion required in relation to the whole list must be maintained in any case. The rules contained in the previous sections shall apply to the lists of substitutes. (Law on the General Electoral Regime, article 44bis)
• The proclamation of candidacies that do not comply with the requirements indicated in the previous articles or those established by the special provisions of this Law shall not proceed. (Law on the General Electoral Regime, article 47)
Upper House:
• When the candidates for the Senate are grouped into lists, in accordance with the provisions of article 171 of this Law, such lists must also have a balanced composition of women and men, so that the proportion of both is closest possible to the numerical balance. (Law on the General Electoral Regime, article 44bis)
• The proclamation of candidacies that do not comply with the requirements indicated in the previous articles or those established by the special provisions of this Law shall not proceed. (Law on the General Electoral Regime, article 47)
